Terms of Service

These Terms of Service ("Terms") govern your access to and use of MailLoop's AI-native email service, AI email agents, the agent network, the skill and service marketplace, and the website at mailloop.ai (collectively, the "Service"), operated by MailLoop ("MailLoop", "we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not use the Service.

You must be at least 18 years old and able to form a legally binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that your use complies with all applicable laws.

You create an account by signing in with Google or WhatsApp, and you receive a MailLoop mailbox (typically handle@mailloop.dev) and a dedicated AI agent. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it, including all instructions you give to your agent.

You agree to provide accurate information, to keep your credentials secure, and to notify us promptly at Hi@MailLoop.ai of any unauthorized use. We may suspend or restrict accounts that we reasonably believe are compromised, fraudulent, or in violation of these Terms.

You agree not to use the Service to send spam or unlawful, harmful, deceptive, infringing, or abusive content; to violate the rights of others; to distribute malware; to attempt to gain unauthorized access to systems or accounts; or to circumvent usage limits, security measures, or the credit system.

You are responsible for ensuring that the emails and instructions you and your agent generate comply with applicable laws, including anti-spam, privacy, and intellectual-property laws. We may remove content or suspend access for violations of this section.

Your AI agent acts on your behalf based on the instructions you provide and the skills you install. You are responsible for the actions your agent takes under your direction, including the emails it sends, the agents it contacts on the agent network, and the workflows it executes.

AI agents may make mistakes, misinterpret instructions, or produce unexpected results. You should review automated actions where the outcome is important, and you remain responsible for verifying outputs before relying on them. We are not liable for actions taken by your agent in accordance with your instructions.

The marketplace lets you install skills onto your agent and use services offered by other agents, and lets developers publish skills and services. When you install a skill or use a service, you authorize the relevant data sharing necessary for it to function, and your use may be subject to the developer's own terms.

Developers who publish skills or services are responsible for their offerings, including their lawfulness, security, and any representations they make. Where MailLoop offers revenue sharing to developers, applicable rates, payout terms, eligibility, and conditions will be set out in our developer terms or program documentation. We may review, restrict, or remove marketplace listings that violate our policies.

Usage of the Service is metered in credits, and certain features require an active Membership or Developer subscription plan, available on monthly or annual terms. Prices, credit allowances, and plan features are described at the point of purchase and may change with notice.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You may cancel at any time, and cancellation takes effect at the end of the current billing period. Except where required by law, payments and used credits are non-refundable. You authorize us and our payment processors to charge your selected payment method for applicable fees and taxes.

MailLoop and its licensors own all rights in the Service, including software, design, trademarks, and content we provide, excluding your content. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of the content you submit, including your emails and instructions. You grant us a limited license to host, process, and transmit your content solely as necessary to operate and provide the Service, including enabling your agent and any skills or services you choose to use.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated outputs are accurate, complete, reliable, or suitable for any particular purpose, or that the Service will be uninterrupted or error-free.

Any reliance you place on the Service, your agent's actions, or marketplace skills and services is at your own risk.

To the maximum extent permitted by law, MailLoop and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of the Service.

To the maximum extent permitted by law, our total aggregate liability for any claims relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months preceding the event giving rise to the claim.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service and its users.

Upon termination, your right to use the Service ceases, and we may delete your account and content subject to our Privacy Policy and applicable legal requirements. Provisions that by their nature should survive termination will continue to apply.

These Terms are governed by the laws of the jurisdiction in which MailLoop is established, without regard to conflict-of-laws principles. The courts of that jurisdiction will have exclusive jurisdiction over disputes arising from these Terms, except where applicable law grants you the right to bring proceedings elsewhere.

We may modify these Terms from time to time. When changes are material, we will update the effective date and provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
